"User," "client," or "you" refers to anyone accessing or using our website or engaging our services.

By visiting our website or purchasing our services, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree to any part of these Terms, please stop using our services right away.

We may update these Terms and Conditions periodically. Any changes will be effective once posted on our website. You are encouraged to review this document regularly, as continued use of our services implies acceptance of any changes made.

Our services are intended for clients of legal age (18 years or older) who have the capacity to enter into legally binding agreements. By using our website and engaging our services, you confirm that you meet these requirements.

CompanyProfileDesign.my respects and protects intellectual property. By engaging with us, you agree to the following:

• Ownership of Materials: All designs, concepts, drafts, and deliverables created by CompanyProfileDesign.my remain our intellectual property until payment is made in full. Once the client completes all payments, ownership of the final design deliverables is transferred to the client.
• Use of Third-Party Assets: Our designs may incorporate third-party assets (e.g., stock images, and licensed fonts). These assets remain the property of their original owners, and clients agree to adhere to the respective licenses and usage restrictions associated with each asset.
• Company Branding: We reserve the right to include a discreet branding mark on designs (such as "Designed by CompanyProfileDesign.my") unless otherwise agreed in writing. Any removal of our branding is subject to an additional fee.

CompanyProfileDesign.my offers the following design and printing services:

• Company Profile Design and Presentation Services: We create professionally designed company profiles and PowerPoint presentations tailored to showcase your brand.
• Logo and Branding Services: We offer logo design that captures and represents the essence of your brand.
• Brochures, Coffee Table Books, and Catalogues: We design and, where applicable, print high-quality brochures, coffee table books, and catalogues that effectively communicate your company's story.
• Annual Reports and Other Corporate Documents: Our team designs detailed annual reports and other essential corporate materials.

Each project may vary in scope and deliverables, but all services include the following commitments:

• Detailed Consultation: We begin each project with a consultation to understand your design needs, brand guidelines, and expectations. This may include multiple touchpoints for complex projects.
• Customised Design Concepts: Our designers develop original concepts based on your brief, ensuring a unique design that aligns with your brand identity.
• Deliverables and Formats: Upon final approval and completion of payment, we provide the final deliverables in the agreed formats (e.g., PDF, JPEG, PNG, PPT). Additional formats or editable files are available upon request and may incur extra fees.
• Printing Services: We offer printing for certain design types. Our printing options are discussed during consultation and may vary based on client needs, materials, and budget.

• Quotations: Upon inquiry, we will provide a custom quotation based on the scope, complexity, and nature of your requested services. Quotations are valid for a few days only.
• Payment: A specific percentage of deposit is required before any design work begins, with the remaining balance due upon completion. Full payment for printing is required prior to production.
• Approval: The client is responsible for reviewing and approving the final design before printing. Once approved, we proceed with printing, and any changes post-approval may incur additional charges.

After placing an order, you will receive an order confirmation outlining the scope, fees, and anticipated timelines:

• Review and Acceptance: Please review the order confirmation thoroughly. Any corrections or clarifications must be communicated within 2-3 days of receipt.
• Project Timeline: The order confirmation will contain estimated delivery dates. These are based on standard timelines but may adjust depending on project complexity or if further revisions are requested.

Clients are responsible for providing accurate and complete information for each project. This includes company information, branding guidelines, and design specifications:

• Accuracy: CompanyProfileDesign.my relies on the accuracy of client-provided information for all design and printing services. We are not liable for delays or issues resulting from incomplete or inaccurate details.
• Contact Information: It is the client's responsibility to ensure that all contact information is up to date. Failure to respond to requests for feedback or clarification may impact project timelines.
• Timely Approvals and Feedback: Respond promptly to design drafts and requests for feedback. Delays may result in changes to the delivery timeline.
• Copyright Clearance: Ensure that all content provided to us (such as images, logos, or texts) is free from copyright infringement, with necessary permissions obtained.

Clients may cancel orders under the following conditions:

• Pre-Design Stage: If a cancellation is requested before any design work begins, a full refund of the deposit is available, minus any administrative fees.
• Post-Design Commencement: If cancellation occurs after design work has started, the deposit will not be refunded, and additional charges may apply for work completed up to the cancellation date.
• Termination by CompanyProfileDesign.my: We reserve the right to cancel an order if the client violates these Terms or if unforeseen circumstances prevent project completion. In such cases, we will provide a prorated refund for any unfinished work.

We are committed to client satisfaction and offer a structured revision policy:

• Number of Revisions: Our services typically include three rounds of revisions as part of the initial project scope. Additional revisions may incur an extra fee.
• Scope of Revisions: Revisions are intended for minor changes to the design, such as colour adjustments, text edits, or layout refinements. Requests that significantly alter the original brief may be considered a new service and priced accordingly.
• Revision Turnaround: Each round of revisions is typically completed within the specified time, depending on the scope. Delays in client feedback may impact the timeline.

Our refund policy includes conditions under which refunds may be eligible and those under which they are not:

• Eligibility for Refunds:
• If CompanyProfileDesign.my fails to deliver the agreed design or service within the stipulated timeline (without prior agreement of an extension), clients may request a refund.
• If a design does not meet the agreed-upon specifications after multiple rounds of revisions, clients may request a partial refund at our discretion.
• Ineligibility for Refunds:
• Refunds are not available for completed services that the client has approved.
• Requests for refunds based on minor dissatisfaction after the project has been completed or for reasons outside the original brief are not eligible.
• Refunds are not granted once printing has commenced, as printing services are final upon client approval.

• Transfer of Ownership: Upon full payment, the final design files become the property of the client. Clients are free to use these designs as they see fit, in accordance with these Terms.
• Editable Files: Ownership transfer applies only to the final design files (e.g., PDF, PNG, JPEG). Editable files (e.g., AI, PSD) remain the property of CompanyProfileDesign.my. Editable files are available upon request and may incur additional fees.
• Portfolio Usage: We reserve the right to showcase completed designs in our portfolio, marketing materials, or social media. Clients who prefer their projects not to be publicly displayed must notify us in writing.

While we strive for excellence in all services, our liability is limited as follows:

• No Liability for Approval Errors: Once a design is approved by the client, CompanyProfileDesign.my is not responsible for errors, omissions, or inaccuracies. Clients are advised to carefully review all design materials before final approval.
• Service Availability: We are not liable for any interruptions in service availability due to factors outside our control, including but not limited to technical issues, network failures, or third-party supplier disruptions.
• Indirect Damages: CompanyProfileDesign.my shall not be liable for any indirect, consequential, or incidental damages arising from or related to the use of our services, including but not limited to loss of business, revenue, profits, or data.
• Maximum Liability: Our maximum liability for any claim, whether in contract, tort, or otherwise, shall not exceed the amount paid by the client for the specific service in question.

Both CompanyProfileDesign.my and the client agree to maintain confidentiality concerning all information shared for the purpose of the project. Neither party shall disclose any proprietary or sensitive information to third parties without written consent except as required by law.

• Governing Law: These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or related to these Terms shall be resolved in accordance with Malaysian law.
• Dispute Resolution: We aim to resolve any disputes amicably. If a resolution cannot be reached, disputes shall be settled through arbitration in Malaysia, with each party bearing its own legal costs.

CompanyProfileDesign.my provides design services on an "as is" basis. We make no warranties, express or implied, regarding the suitability, accuracy, or completeness of our services for any particular purpose.
